It would appear that we are now a police state where a presidentially sanctioned arm of the federal government has the authority to arrest anyone, anywhere, for any cause. They are answerable to no higher authority within the judicial system. They have carte blanche from our king to do what they want. They are outside our court system.
Stephen Miller went on camera to suggest that habeas corpus may be suspended at any time they see fit. The president who took an oath to uphold the Constitution of the United States, when asked by a reporter if he would honor that oath, said he wasn’t sure if that was necessary. He would leave the matter up to his lawyers.
This is based on observations from events of the past three months and the activities as recent as today when a mayor (Newark, NJ) wanted to access a facility, operated by a contractor, was arrested by ICE officials. That facility was not licensed by the city to house detainees and the mayor wanted to make sure city laws were not being violated. This was cause for his arrest by ICE.
It seems only a matter of time before one of these confrontations turns violent and the president will seize that opportunity to justify martial law. The courts are of no concern for this president, and he has no fear of congress who continue to praise the man out of fear of reprisal. He has now resorted to rule by fear as ruling with respect for his office is no longer necessary. Politicians fear him. Business leaders fear him. Judges fear him. We should all fear him.
Historical note: The Enabling Act, also known as the "Law to Remedy the Distress of the People and the Reich," was a law passed by the German parliament (Reichstag) on March 23, 1933, granting the German Cabinet, and particularly Chancellor Adolf Hitler, the power to enact laws without the Reichstag's consent. Essentially, this law allowed Hitler to rule by decree, bypassing the normal legislative process. Hitler could therefore bypass their constitution to act as he saw fit. This act marked the transition of democratic Germany to full dictatorship.
